**Introduction and Affiliates**
This agreement ("Terms of Service") governs the use of all products and services provided by FOGST Labs, including the FOGST Plate. All references to "FOGST Labs," "we," "us," or "our" in these Terms of Service include our subsidiaries, affiliates, contractors, and related entities. By purchasing any of our products, you ("the user" or "customer") agree to abide by these Terms of Service. Any failure to comply with these terms may result in the suspension or termination of your use of the product and legal action where applicable.
**Compliance with Laws and Legal Disclaimer**
The FOGST Plate is intended solely for private settings, exhibitions, car meets, events, and other off-road use. Public road use of the FOGST Plate is strictly prohibited. It is the customer's sole responsibility to ensure that the purchase and use of the FOGST Plate comply with all applicable local, state, provincial, federal, or international laws and regulations. FOGST Labs and its affiliates assume no liability for any legal penalties, fines, or consequences arising from the improper or illegal use of the FOGST Plate on public roads. The customer acknowledges and agrees that FOGST Labs provides no guarantee or representation regarding the legality of the product in their jurisdiction, and any legal responsibility remains entirely with the customer.
**Customer Responsibility for Dimensions and Product Compatibility**
All FOGST Plates are manufactured according to specific dimensions that are clearly listed on our product pages. The customer is solely responsible for verifying that the dimensions provided are suitable for their specific use case. For example, while a FOGST Plate may be advertised as compatible with certain regions (e.g., Europe, UK, etc.), we do not guarantee compatibility with every license plate size within those regions. Customers must measure their license plates to ensure that the dimensions match the specifications provided before purchasing.
All license plates used with our FOGST Plate covers must not exceed 2mm in thickness to fit into our brackets. It is the customer's responsibility to verify that their license plate meets this requirement. No returns or refunds will be provided for products that do not fit due to incorrect thickness or dimensions of the user's license plate. The FOGST Plate must be used on flat license plates, as it is embedded in a glass cover that offers no flexibility.
**Liability Disclaimer**
The FOGST Plate is a privacy accessory intended for off-road use and does not guarantee protection against theft, vandalism, or other criminal activities. FOGST Labs disclaims all liability for any damages, losses, or legal issues resulting from the use or misuse of the FOGST Plate. The customer assumes full responsibility for the use of the FOGST Plate, including any consequences resulting from misuse or illegal use. FOGST Labs will not be held accountable for damages, including indirect, incidental, or consequential damages, regardless of how they arise.
**Legal Use Disclaimer**
FOGST Plates are designed for use in private settings such as exhibitions, car shows, or on private property. They are not designed or approved for public road use, and the customer is responsible for verifying that the use of the FOGST Plate complies with local laws. In some jurisdictions, even the purchase or possession of this product may be restricted. It is the customer's responsibility to confirm that the purchase, use, or installation of the FOGST Plate is legal in their region or country. FOGST Labs and its affiliates assume no liability for any consequences arising from the illegal use or purchase of the product in prohibited jurisdictions. By purchasing the product, the customer acknowledges that they have verified and understood the applicable laws in their region.
**Package Liability and Transfer of Responsibility**
FOGST Labs is responsible for the safe packaging, inspection, and dispatch of products until they reach the customer's designated customs office. Once a product reaches customs in the customer's country, FOGST Labs is no longer liable for any delays, holds, or issues regarding customs clearance. We will assist in contacting customs and shipping providers to resolve issues; however, we do not guarantee resolution, nor are we obligated to replace or refund the product in these circumstances. The customer is solely responsible for paying any applicable customs duties, taxes, or import fees required for the release of the package.
**Customs Refusal and Return Shipping**
If the customer refuses to pay applicable customs fees or duties, and the package is returned to FOGST Labs, the following fees will be deducted from any potential refund:
- The initial shipping cost to the customer's address.
- The cost of return shipping to FOGST Labs.
- A 20% fee to cover handling, processing, and legal expenses.
The final refund amount is determined at the sole discretion of FOGST Labs. Refunds may not cover the full purchase price, and we reserve the right to refuse a refund depending on the circumstances of the return.
**Handling Time and Shipping**
For non-preorder items, FOGST Labs aims to process and ship orders within one business day. However, during periods of high demand, handling time may extend to up to 7 business days. Customers will be notified of any delays via email. We strongly recommend that customers regularly check their email, including spam folders, for updates regarding their orders. Failure to monitor email communications will not be grounds for expedited handling or compensation for delays.
**Refund and Exchange Policy**
Pre-order items are fully refundable until the product is shipped. Once a product has been shipped, refunds are only available for defective products, provided that:
- The product is unused and in the same condition as received.
- The original packaging, including warranty stickers, remains intact.
- The customer provides proof of purchase within 30 days of receipt.
If these conditions are met, the customer may request a return or exchange. FOGST Labs will inspect the product and notify the customer whether the refund or exchange is approved. If approved, the customer may receive an exchange or store credit of equal value.
**Order Acceptance and Cancellation**
All orders are subject to acceptance by FOGST Labs. We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to cases of suspected misuse, incorrect pricing, or product unavailability. If an order is canceled by FOGST Labs, a full refund will be issued to the customer.

FOGST Labs makes no guarantee or representation regarding the legality of the product in the purchaser’s jurisdiction. The customer assumes full liability for any penalties, fines, or legal action resulting from the use of the product in non-compliant or illegal settings. The customer is also responsible for ensuring that the product matches their vehicle's requirements, and no refunds or returns will be offered for incorrect sizing.
**Responsible and Lawful Use**
By purchasing the FOGST Plate, the customer agrees to use the product in a responsible, ethical, and lawful manner. Any misuse, whether intentional or unintentional, is the sole responsibility of the customer. FOGST Labs will not be held liable for any consequences or damages arising from the misuse of the product. The customer agrees to comply with all laws and regulations that govern the use of the FOGST Plate.
**Acknowledgment and Binding Agreement**
By purchasing and using the FOGST Plate, you acknowledge that you have read, understood, and agreed to these Terms of Service. This agreement constitutes a binding contract between you and FOGST Labs. If you disagree with any part of these terms, you are advised not to purchase or use the FOGST Plate.
**Amendments and Updates**
FOGST Labs reserves the right to modify these Terms of Service at any time without prior notice. It is recommended that users regularly review these terms to stay informed of any updates. Continued use of the FOGST Plate following any changes to these terms constitutes acceptance of those changes.
